Abstract

Abstract

Elections are the life blood of any democracy, offering citizens the opportunity to choose theirleaders and shape the direction of their country. The timely and fair resolution of electiondisputes is necessitated. This study provides proof of the increasing circumstances of postelectionpetitions and evidential court determinations of election outcomes in the FederalRepublic of Nigeria. Since 1999, Nigeria has organised four cycles of national elections. Eachof the elections was contested either in or out of court (in the latter case, for example, in theform of election violence). In Nigeria, the delayed resolution of election petitions has becomea persistent issue undermining the democratic process. This paper investigates the causes ofthese delays, the importance oftimely election dispute resolution, and the implications fordemocratic stability. The primary objective is to identify factors contributing to prolongedelection petitions and propose reforms to enhance the judicial system's efficiency. Key gapsinclude judicial inefficiencies, political interference, and a lack of clear guidelines for handlingpetitions. The paper relied largely on the qualitative method of analysis, in which relevanthistorical evidences, books, journals and newspaper reports were content analyzed. Keyfindings indicate that the backlog of cases, judicial under-resourcing, political pressure, andunclear procedural timelines are significant contributors to delays. These delays erode publictrust in the electoral system and create political instability. The paper recommends judicialefficiency reforms, clearer timelines, judicial independence safeguards, and technologyintegration to streamline the process and ensure fair, timely adjudication. Implementing thesereforms will foster democratic stability by improving the credibility of Nigeria's electoralsystem and enhancing public confidence in the legitimacy of elected leaders.
